When a company goes bankrupt or enters a procedure of judicial restructuring, we are qualified to insure proper defense of interests of debtors, creditors, creditors’ committees, etc. We also aim to help clients in pre-litigation matters so as to avoid the opening of such procedures. Our expertise includes assisting creditors, be it national or foreign, in case of large or small scale restructurings/bankruptcy cases, including cases of bankruptcy of company members of wide national groups. For creditors, especially in case of large sums involved, it is imperative to be duly represented and attentively control the development of the procedure, as well as to respect, for the recognition of rights, the deadlines established by Romanian Law. Creditors also need to know their rank in case of distribution, as some entities (State, Financial Administration, creditors having mortgages and securities), are paid first from the incomes obtained in bankruptcy, which increases the risk for the private companies or other debtors with no securities. Romanian law prescribes clear rules and deadlines, and it is imperative to pay attention to them, in particular for debtors against which a claim for opening the restructuring/bankruptcy procedure has been issued. Furthermore, in some cases if the company enters liquidation, administrators are held personally liable for some or all of a company’s debts. Criminal aspects, as well as future consequences for involvement in commercial activity, may also be involved.
